2. Valid Legal Process Request & Requirements

All requests for Member Information must be made with valid and sufficient legal process properly served on us. Before seeking legal process, please check the location of the given Member whose information you are seeking. However, as an EU-based company, https://www.windberge.com/ and WinG MEE AB may require that non-EU legal process be domesticated. Receipt of legal process by these means is only for our convenience and does not waive any objections, including lack of jurisdiction, invalid form of process, or improper service.

 

https://www.windberge.com/ and WinG MEE AB will object to overly broad, vague, or otherwise inappropriate requests. We require a valid and sufficient legal process (for example court order), properly served, that compels us to disclose records or information about a Member ("Member Information"). The legal process must contain enough identifying information so that we can determine the given member’s account. For example, a nickname or common name does not uniquely identify a member’s account. Thus, Your legal process should include information, such as an email address, transaction ID, user- or shop name, or payment information. In addition, all law enforcement requests must identify the specific records requested, and your request needs to include the name of the issuing authority and agent, email address from a law-enforcement domain, or a direct contact phone number. https://www.windberge.com/ and WinG MEE AB shall only provide information when it is consistent with our Terms of Use, Privacy Policy, and applicable law or in emergency situations.

3. Emergency Circumstances

If your request for information involves an emergency regarding a danger of death or serious physical injury to a member of our community or any member of the public, please email from your official email address to wgertrud@gmail.com and mark your email ´Emergency´.  In your mail provide the following information:

1. Your name and title, the government agency you work for, and your full contact information (government email address, phone number, and fax number when it´s applicable);

2. A summary of the facts about the emergency, including how the situation poses a danger of death or serious physical injury to a given person (/-s);

3. The identity of the person or persons who are in danger;

4. The specific records sought and how they relate to the emergency; and

5. Why legal process cannot be obtained, and why the records must be disclosed without delay.

Individuals aware of an emergency situation should immediately and directly contact local law enforcement.

4. Notice to the Member Whose Records Are Requested

If it is feasible, https://www.windberge.com/ and WinG MEE AB may notify the affected Member before disclosing records or information requested about them, unless legally prohibited from doing so, or where https://www.windberge.com/ and WinG MEE AB have a clear indication of illegal conduct and prior notification would be counterproductive. https://www.windberge.com/ and WinG MEE AB may also allow the Member enough time to appear and object to the legal process in court, if necessary.

5. Witness Testimony Requests

https://www.windberge.com/ and WinG MEE AB generally will object to requests to provide witnesses for trial or deposition.

6. Cost Reimbursement

https://www.windberge.com/ and WinG MEE AB may seek reimbursement for our costs directly incurred in searching for, assembling, collecting, and preparing records or information for production.
