Reporting Portal for Digital Services Act (DSA)

To enable direct communication, by electronic means, with EU Member States’ authorities, the European Commission, the European Board for Digital Services, and Trusted Flaggers reporting intellectual property violations designated by EU Member State Digital Services Coordinators https://www.windberge.com/ and WinG MEE AB set up a Reporting Portal. However, you may also use the email address wgertrud@gmail.com. Notices to https://www.windberge.com/ and WinG MEE AB should be provided in English language.

DSA orders to act against illegal content

Under the DSA orders to act against illegal content issued by EU Member State national judicial or administrative authorities must ensure that the order includes the following:

• a reference to the legal basis under Union or national law for the order;

• a statement of reasons explaining why the information is illegal content, by reference to one or more specific provisions of Union law or national law in compliance with Union law;

• information identifying the issuing authority;

• clear information enabling https://www.windberge.com/ and WinG MEE AB to identify and locate the illegal content concerned, such as one or more exact URL and, where necessary, additional information;

• information about redress mechanisms available to https://www.windberge.com/ and WinG MEE AB and to the user who provided the content;

• where applicable, information about which authority is to receive the information about the effect given to the orders;

• the territorial scope of that order, based on the applicable rules of Union and national law;

• that the order is provided in the English language; where the order is not drafted in English, the order must be accompanied by a translation into English.

DSA orders to provide information

Under the DSA, Member States must ensure that orders to provide information about https://www.windberge.com/ and WinG MEE AB user(s), issued by the relevant national judicial or administrative authorities on the basis of the applicable Union law or national law in compliance with Union law, include the following:

• a reference to the legal basis under Union or national law for the order;

• information identifying the issuing authority;

• clear information enabling https://www.windberge.com/ and WinG MEE AB to identify the specific user(s) on whom information is sought, such as one or more account names or unique identifiers;

• a statement of reasons explaining the objective for which the information is required and why the requirement to provide the information is necessary and proportionate to determine compliance by the recipients of the intermediary services with applicable Union law or national law in compliance with Union law unless such a statement cannot be provided for reasons related to the prevention, investigation, detection, and prosecution of criminal offenses;

• information about redress mechanisms available to https://www.windberge.com/ and WinG MEE AB and to the user(s);

• where applicable, information about which authority is to receive the information about the effect given to the orders;

• that the order only requires https://www.windberge.com/ and WinG MEE AB to provide information already collected for the purposes of providing the service and which lies within its control;

• that the order is provided in the English language; where the order is not drafted in English, the order must be accompanied by a translation into English.
